GENERAL CONDITIONS OF SALE

1 APPLICATION

These general conditions of sale apply to the sales and provision of services concluded by the company TENUTA MICOLI SRL based in Via XXIV Maggio, are in Guastameroli in Frisa (CH)

2 CAPACITY

Any customer of the hotel acknowledges that they have the ability to contract, that is, that they are of legal age, that they are not under guardianship or guardianship, and that they are able to engage the structure they represent, if any.

3 ABSENCE OF RIGHT OF PORTRAIT

In accordance with Art. L.121-20-4 of the Consumer Code, the right to reconsider does not apply to hotel bookings, excluded from the discipline of off-site or remote negotiation. The confirmed booking has the effect of a definitively concluded contract.

4 PRICE

Prices are indicated in EU. VAT is always included unless otherwise stated. The prices indicated include only the services specifically indicated in the booking. At the time of invoicing, any additional services provided by the hotel during the stay or during administration will be added to the price indicated in the booking. The prices indicated on the site are subject to change without notice and only the price indicated in the booking confirmation is contractual.

5 MODIFICATION OF A RESERVATION

Any modification or partial or total cancellation must be the subject of a written notification from the customer to the company Tenuta Micoli srl. In case of disagreement, Tenuta Micoli srl reserves the right to cancel the application and to apply specific penalties.

6 METHOD OF PAYMENT

The payment of all services takes place, during the stay and / or at the end of the administration, directly at the facility.

There are three possible ways of payment following authorization:

by check made out to Tenuta Micoli srl sent directly to the headquarters;

by debit or credit card;

by bank transfer.

7 FORCE MAJEURE

Force majeure is a cause for exemption from liability for failure to provide services, pursuant to and for the purposes of art. 1256 of the unavoidable civil code which prevents either the customer or the hotel from fulfilling all the obligations under the contract or a part thereof. By way of example but not exhaustively: strike, insurrection, riot, prohibitions promulgated by government or public authorities.

It is expressly agreed that force majeure suspends, for the parties, the execution of their mutual obligations and that each party bears the burden of the resulting costs. In this case, customers will only pay for any additional costs incurred to allow the journey to continue, following the occurrence of a case of force majeure.

 

8 OVERNIGHT STAY IN ANOTHER HOTEL

In case of total or partial unavailability independent of the will of the structure and except in case of force majeure, Tenuta Micoli srl reserves the possibility of partially or totally staying the participants in a nearby hotel, of equivalent or higher category. Transfer costs are borne by the Estate.

9 APPLICABLE LAW

Any complaint, to be taken into consideration, must be made at the facility within 15 days from the date of stay. After having contacted the hotel and in the absence of a satisfactory response within a period of 30 days, the customer can appeal to the Tourism and Travel Ombudsman, whose contact details and methods of appeal are available on the website: www.mtv.travel.

Any controversy, complaint or quarrel about how to book a stay, a hotel room, a meal or a room rental are subject to Italian law and the jurisdiction of the Court of Lanciano.
